Welcome to Adaptive Kidz. Adaptive Kidz is an ecommerce brand operated by Capital Kidz. These Terms of Service (“Terms”) govern your use of adaptivekidz.com (the “Site”) and purchases made through the Site. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or use the Site with the involvement of a parent or legal guardian, to make a purchase. You represent that the information you provide is accurate and that you are legally able to enter into this agreement.
2. Your account
If you create an account, you are responsible for keeping your credentials confidential and for activity under your account. Notify us promptly at service@adaptivekidz.com if you believe your account has been used without authorization.
3. Products, pricing, and availability
- We work to display product descriptions, specifications, colors, images, compatibility, and prices accurately, but we do not warrant that every detail is error-free.
- Prices are in U.S. dollars and may change without notice.
- Products and configurations are subject to availability. We may limit quantities, discontinue products, or cancel an unavailable item.
- If a product is listed with an incorrect price or materially incorrect information, we may refuse or cancel the order. If you were charged, we will refund the canceled amount.
4. Orders and payment
Your order is an offer to purchase. We may accept or decline it for a lawful reason, including availability, suspected fraud, payment authorization failure, or a pricing error. Payment is processed by third-party providers through Shopify. By placing an order, you authorize us and our payment providers to charge the selected method for the order total, including applicable taxes and shipping.
5. Fit, measurements, and professional guidance
Adaptive chairs and accessories are fit- and configuration-sensitive. Product information, the Fit Finder, reimbursement guidance, and help from our team are educational shopping support only. They are not a diagnosis, prescription, medical opinion, or substitute for an evaluation by a qualified clinician, therapist, or professional fitter. You are responsible for confirming measurements, capacity, compatibility, intended use, and product specifications before purchase and use.
6. Reimbursement support
We may provide itemized receipts, product specifications, quotes, and other documents that can help you pursue reimbursement through an insurer, school, clinician, flexible spending account, or grant program. We do not determine medical necessity, guarantee coverage or reimbursement, submit insurance claims, or bill an insurer unless we expressly agree otherwise in writing. You remain responsible for verifying eligibility, coverage requirements, deadlines, and claim submission.
7. Shipping, returns, and refunds
Shipping timelines, delivery limitations, return eligibility, cancellation rules, and refund terms are described in our Shipping Policy and Return and Refund Policy. Those policies are incorporated into these Terms and should be reviewed before ordering.
8. Promotions and discount codes
Promotions, coupons, and discount codes are subject to their stated terms, cannot be combined unless expressly allowed, have no cash value, and may be changed or ended at any time.
9. Email and text communications
By providing contact information, you consent to receive transactional messages related to your order or request. If you separately opt in to marketing, you may receive promotional email or text messages. Marketing consent is not a condition of purchase. You may unsubscribe from marketing email using the link in the message. For SMS/MMS, message frequency varies and message and data rates may apply; reply STOP to cancel or HELP for help. 10. Intellectual property
The Site and its content, including logos, text, graphics, images, product presentation, and design, are owned by or licensed to Adaptive Kidz or Capital Kidz and are protected by intellectual-property laws. You may not copy, reproduce, distribute, or use that content or our trademarks without written permission.
11. Reviews and user content
If you submit a review, photograph, message, or other content, you grant Adaptive Kidz and Capital Kidz a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and publish it in connection with our business. You are responsible for your content and agree that it is accurate, lawful, and does not infringe the rights of others.
12. Acceptable use
You may not use the Site to violate law; infringe rights; harass, abuse, or discriminate; submit false or misleading information; introduce malicious code; collect another person’s information without authorization; spam, phish, scrape, or circumvent security; or attempt unauthorized access to the Site, accounts, or systems. We may restrict access for prohibited use.
13. Third-party links and services
The Site may link to third-party websites, manufacturers, payment providers, insurers, grant programs, or other services. We do not control and are not responsible for their content, availability, products, decisions, security, or privacy practices. Accessing them is at your own risk.
14. Product safety, instructions, and recalls
You are responsible for reading and following all manufacturer instructions, warnings, capacity limits, positioning guidance, maintenance requirements, and intended-use restrictions. Adult supervision and any clinician-recommended fitting or positioning must be followed. Manufacturer warranties, when offered, are provided by the manufacturer. If a product is recalled, follow the remedy provided by the manufacturer or the U.S. Consumer Product Safety Commission; we will share recall information we receive when reasonably practicable.
15. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. ANY APPLICABLE PRODUCT WARRANTY IS PROVIDED BY THE MANUFACTURER.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ADAPTIVE KIDZ, CAPITAL KIDZ, AND THEIR OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM THE SITE, PRODUCTS, OR SERVICES. OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THAT CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
17. Indemnification
You agree to indemnify and hold harmless Adaptive Kidz and Capital Kidz from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Site, violation of these Terms, or infringement of another person’s rights.
18. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Montgomery County, Maryland, and you consent to their jurisdiction.
19. Changes to these Terms
We may update these Terms. Changes take effect when posted, as shown by the “Last updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.
20. General
If a provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and other posted policies, are the entire agreement regarding your use of the Site and purchases from us.
